Use of Services

By engaging with The Video Crafters LLC ("we," "us," or "our") and utilizing our services, you agree to the following terms:

Commencement of Services: The official start date of your trial or monthly plan begins on the date of your kick-off call with your assigned creative director. Subject to your adherence to this Agreement and timely payment, we will provide the applicable services for the duration of your chosen service.
Scope of Services: Our services encompass various offerings, including but not limited to:
- Creation of files and projects owned by The Video Crafters LLC.
- Delivery of MP4 files to clients upon project completion.
- Kick-off calls to initiate project discussions.
- Unlimited revisions within the project timeline.
- Consultation via video calls.
- Provision of custom illustrations or stock footage as needed.
Usage Limitations: While we accept unlimited requests and revisions, project output volume may vary based on plan specifics and project complexity. A comprehensive timeline will be provided at the project outset to ensure clarity on deadlines and project milestones.
Speed of Deliverables: The pace of deliverables is contingent upon your selected monthly plan. Factors influencing output volume include plan type, request volume, and request complexity. Consideration of our premium plan may enhance daily work volume capacity.
Ownership of Content: You retain sole ownership and control of all information, data, or materials provided to us for use in the Services ("Customer Content"). By submitting Customer Content, you affirm ownership or possess the necessary rights, licenses, and authorization for distribution. You grant us a worldwide, royalty-free, non-exclusive license to access and utilize Customer Content solely to provide the Services.
Ownership of Deliverables: You are the exclusive owner of all rights, title, and interest in the deliverables, including any intellectual property rights therein. Deliverables qualifying as "work made for hire" under applicable law are deemed as such for you. In instances where deliverables do not constitute "work made for hire," we irrevocably assign all rights to you upon full compliance with this Agreement and payment of applicable fees.
Pre-existing Materials: We may incorporate pre-existing materials in providing the Services. We and our licensors retain sole ownership of such materials. You are granted a limited, non-transferable license to use, display, and distribute these materials as necessary for utilizing the Services or deliverables.
Confidentiality: All virtual client interactions with The Video Crafters LLC staff are recorded for quality assurance and training purposes. Confidential information shared within these interactions is safeguarded and protected.

Payment Terms

Clients are required to make a 50% deposit upon commencement of a project, with the remaining 50% due upon completion. Payments are to be made in accordance with the provided invoice.

At The Video Crafters LLC we prioritize transparency and fairness in all our client interactions. To ensure clarity regarding refund requests, we have established the following policy:

Refund and Administrative Fee: A small administrative fee will be deducted from all refund requests, regardless of when the request is made. This fee covers administrative costs associated with processing the initial deposit and includes a standard deduction of 10% of the deposit amount, within the first 90 days. After the three months period, 30% administrative fee is deducted.
Refund Expiry: After one year (365 days) from the date of payment for the deposit, clients are no longer eligible to request a refund. Funds held beyond this timeframe will be considered non-refundable and will be retained by The Video Crafters LLC.
Communication and Exceptions: We understand that unique circumstances may arise, and exceptions to this policy may be necessary. Clients facing extenuating circumstances are encouraged to communicate with us directly to discuss potential solutions.
Policy Application: This refund policy applies specifically to deposits made for projects with The Video Crafters LLC. Different policies may apply to other services or products offered by our company.
Policy Acknowledgment: By making a deposit for a project with The Video Crafters LLC, clients acknowledge and agree to adhere to the terms outlined in this refund policy.

Please be aware that The Video Crafters LLC reserves the right to revise this policy at any time, with any modifications promptly communicated to clients.

Confidential Information

During the course of our engagement, both parties may disclose confidential information ("Confidential Information"). Each party agrees to hold the other's Confidential Information in strict confidence and not disclose it to any third party, except as required to fulfill the Services. The confidentiality obligations shall survive termination of this agreement for a period of five (5) years.

All content provided on this Site, including but not limited to text, graphics, logos, images, videos, audio clips, digital downloads, and data compilations, is the property of The Video Crafters or its content suppliers and is protected by copyright laws. The compilation of all content on this Site is the exclusive property of The Video Crafters and is protected by copyright laws.

Liability Waiver

The Video Crafters shall not be held liable for any lost profits, revenues, data, financial losses, or indirect, special, consequential, exemplary, or punitive damages arising from the use or inability to use our services.

Indemnification

You agree to defend, indemnify, and hold The Video Crafters harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of our services or any deliverables. You shall cooperate as required by us in the defense of any claim.
